Not as Routine as You Might Think
Phase I Environmental Site Assessments (ESAs) are often requested for commercial real estate transactions, including lender financing or re-financing, foreclosures, and other programs as part of the due diligence conducted on a commercial property. A Phase I ESA will identify real or potential environmental impacts to a property thus providing insight into the environmental risks associated with the property. And if conducted properly, will provide the users of the Phase I ESA Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) liability protections.
Of course, not all circumstances require a full Phase I Environmental Site Assessment. If the buyer or lender is not looking to qualify for CERCLA liability protection, a limited-scope environmental report can offer a low cost solution. By starting with a desktop review, our clients have the option to easily upgrade to more advanced investigations should questions of potential environmental impacts arise.
